Article 1: General provisions

The electronic web shop of Zenderservice, a BV with registered office in Zele (Belgium), Dendermondebaan 66, Company number: BE 0458.015.192 (hereinafter Zenderservice) offers its customers the opportunity to purchase products online. These General Terms and Conditions ("Terms") apply to all items from the Zenderservice range and to every purchase that the customer places with Zenderservice.

The customer accepts that these conditions will be the only ones applicable, to the exclusion of his own general or specific (purchase) conditions, even if these would stipulate that they are the only ones applicable.

Article 2: Price

All listed prices are always inclusive of VAT and all other taxes that must be borne by the customer. If transport, reservation, or administrative costs are charged, this will be stated separately. The stated price applies exclusively to the items as described verbatim. The accompanying photo is intended for decorative purposes and may contain elements or items not included in the price.

If you wish to place an intra-community order, we kindly ask you to contact us in advance so that we can create a separate order for you. Once your order is finalized, no changes can be made, and VAT refunds will no longer be possible.

Article 3: Offer

Each offer is only open to customers residing in the European Union. The articles are intended for normal use only.

Despite the fact that the website is composed with the greatest possible care, it is still possible that the information provided is incomplete, or contains material errors, or is not up-to-date. If you have specific questions about, for example, dimensions, colours, availability, delivery time or delivery method, we request that you contact us in advance (see article 11).

Zenderservice is only bound to a means obligation with regard to the correctness, topicality or completeness of the information provided. Zenderservice is in no case liable in the event of material errors, typographical errors or printing errors.

The offer is always valid while stocks last and can be changed or withdrawn at any time by Zenderservice.

Zenderservice is entitled to refuse orders without giving reasons, to adjust delivery times, to split deliveries or to attach other conditions to the delivery.

Article 4: Online purchases

The customer has the option to purchase items from the Zenderservice range online.

The purchase is made at the moment the customer receives a confirmation email from Zenderservice. The items are delivered to the customer's home at the specified delivery address or at the specified collection point.

The customer can choose from the following payment options:

  • Credit card
  • Bancontact/Mister Cash
  • iDEAL
  • By bank transfer

Article 5: Retention of title

The delivered items remain the exclusive property of Zenderservice until the customer has paid in full. However, the risk of loss or damage is transferred to the customer from the moment of delivery. The customer undertakes to inform third parties of Zenderservice's retention of title if necessary, for example to anyone who would seize the items that have not yet been paid in full.

Article 6: Complaints

Any visible damage and/or qualitative deficiency of an article or other deficiency in the delivery must be reported immediately, under penalty of forfeiture of all rights.

Article 7: Warranty

a. Legal warranty (only for consumers)

Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. Each article is subject to the legal guarantee from the date of purchase by (or delivery to) the first owner. Any commercial guarantee does not affect these rights.

b. General

To make a claim under the warranty, the customer must be able to present proof of purchase.

For items purchased online and delivered to the customer's home, the customer must first contact Zenderservice, after which the customer must return the item to Zenderservice at his/her own expense.

Any defect must be reported within 14 days of its discovery. After that, any right to repair or replacement will lapse.

The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, water infiltration, neglect, falls, incorrect installation, abnormal or incorrect use, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or modifications to the article, rough handling, poor maintenance, abnormal or incorrect use.

It also does not apply to articles with a shorter lifespan, or wear and tear articles. Defects that manifest themselves after a period of 6 months following the date of purchase, or delivery if applicable, are deemed not to be hidden defects, unless the customer can prove otherwise.

Problems that occur with products due to water infiltration, an empty or defective battery are not covered by the warranty.

The warranty is not transferable.

Article 8: Cancellation period

The provisions of this article apply only to customers who purchase articles online in their capacity as consumers:

  • The consumer has the right to inform Zenderservice that he is cancelling the purchase, without payment of a fine and without giving a reason within 14 days from the day following delivery of the product (not possible for professional purchases with a VAT number).
  • Customers who wish to exercise their right of withdrawal must contact Zenderservice customer service within 14 days of delivery and return the goods at their own expense to Zenderservice, Dendermondebaan 66, 9240 Zele, Belgium within 20 days of delivery of the goods.
  • Goods with a sales price of 100 Euro or more must be returned to us by registered post or by courier.
  • Only items that are in their original and undamaged packaging, together with all accessories, instructions and invoice or proof of purchase can be returned.

Will not be taken back under any circumstances:

  • used, soiled, damaged or incomplete items
  • items whose packaging (or part thereof) was damaged
  • items that cannot be returned due to their nature*
  • items that have been ordered especially for the customer
  • Business purchases

* Example: Items that require a code to be activated so that they cannot be set a second time, such as some smart items as well as code keypads with a specific reset or master code.

Article 9: Privacy

Zenderservice undertakes to use your data exclusively for the execution of the concluded agreement that you conclude by means of your order and to send you information from Zenderservice without obligation. We treat your data as confidential information and will never pass it on, rent it out or sell it to third parties. You can request, improve, change or delete your data that we store in the Zenderservice customer list at any time and you can refuse that Zenderservice uses your data to send you information. It is sufficient to request this in writing at the address stated below: Zenderservice, Dendermondebaan 66, 9240 Zele, Belgium.

The customer is responsible for keeping his login details confidential and for using his password. Your password is stored in an encrypted format, so Zenderservice has no access to your password. Zenderservice strictly respects the Belgian law of 8 December 1992 regarding the protection of privacy in the processing of personal data. You have access via your user profile to all the available data about you on Zenderservice for consultation, modification or deletion.

The Zenderservice website uses cookies. Cookies are a standard internet technology that makes it possible to store and retrieve certain information on the user's system. Cookies cannot be used to identify individuals; a cookie can only identify a machine. Every internet user can set his computer in such a way that cookies are not accepted. If your computer does not accept cookies, you may experience problems during the ordering process. If this is the case, we request that you contact us so that we can still enter your order. Zenderservice keeps online (anonymous) visitor statistics in order to be able to see which pages of the website are visited and to what extent. Article 10: Affectation of validity - non-waiver

If any provision of these terms and conditions is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions. Failure at any time by Zenderservice to enforce any of the rights stated in these terms and conditions, or to exercise any right hereunder, will never be considered a waiver of such provision and will never affect the validity of these rights.

Article 12: Changes to conditions

These conditions are supplemented by other conditions to which explicit reference is made, and the general sales conditions of Zenderservice. In the event of any conflict, these Conditions shall prevail. Zenderservice may change these conditions at any time without further notice. Any purchase after the change implies acceptance by the customer of these new conditions.

Article 13: Evidence

The customer accepts that electronic communications and backups can serve as evidence.

Article 14: Delivery time and problems with delivery

We ship orders from Monday to Friday, every afternoon. The indicated delivery times are indicative, but a shipment via DPD is on average 1 to 2 working days in transit for Belgium and the Netherlands. In exceptional cases, a shipment is on its way longer. If a package is on its way longer than 7 working days, we will start an investigation.

You must inform us within 30 days if you have not received a shipment. If we have not heard anything after this period, we will consider your shipment as delivered.

Article 15: Applicable law - Competent court

Belgian law applies, with the exception of the provisions of private international law regarding applicable law and of the Rome I regulation regarding international sales contracts for movable property. In the event of any disputes, only the courts of Dendermonde have jurisdiction.
